Purchase Dates:

The CHEO 50/50 Raffle (“CHEO 50/50”) is sponsored by the Children’s Hospital of Eastern Ontario (“CHEO”) Foundation (“Sponsor”). The CHEO 50/50 consists of three (3) draws (each, a “Draw”) and will launch on Wednesday, February 21, 2024 at 12:00 a.m. Eastern Time (“ET”) and end on the final Draw purchase deadline, as set out below (“Purchase Period”):

  1. The purchase deadline for the first early bird Draw (“First Early Bird Draw”) is Wednesday, March 6, 2024 at 11:59 p.m. ET;
  2. The purchase deadline for the second early bird Draw (“Second Early Bird Draw”) is Wednesday, March 20, 2024 at 11:59 p.m. ET; and
  3. The purchase deadline for the final Draw (“Final Draw”) is Friday, April 12, 2024 at 11:59 p.m. ET.

Eligibility:

Ticket buyers must be 18 years of age or older. Ticket buyers must be in the province of Ontario at the time of purchase.

The following individuals and their immediate family members living at the same address are excluded from participating in the CHEO 50/50, including, without limitation, purchasing a Ticket (as defined below), receiving a Ticket as a gift, and claiming any Prize (as defined below): (a) Sponsor and board members; (b) members of licensed gaming suppliers providing services to the CHEO 50/50; and (c) any other person directly involved in or responsible for the conduct of the CHEO 50/50 or involved in the sale of Tickets.

Agreement to be Legally Bound by Rules:

By participating in the CHEO 50/50, you are signifying your agreement that you have read and agree to be legally bound by these Official Rules and Regulations (“Rules”).

Tickets:

Official CHEO 50/50 tickets (“Tickets”) will be available for purchase during the Purchase Period: (a) online at cheo5050.ca; and (b) by phone at 1-877-562-5437.

Tickets are available during the Purchase Period at the following set quantities and purchase prices: (a) 10 Tickets for $25; (b) 30 Tickets for $50; (c) 100 Tickets for $100; and (d) 200 Tickets for $175.

Tickets will be sold using an electronic raffle system supplied by Canadian Bank Note Company, Limited.  Canadian Bank Note Company, Limited has been contracted for this lottery and is delivering online services. Miratel Solutions Inc. has been contracted for this lottery and is delivering call centre services.

Ticket buyers will receive their Ticket numbers by email (at the email address provided at the time of purchase). No specific Ticket numbers can be given as numbers are generated randomly.

Participation Conditions and Verification:

To be eligible, Tickets much be purchased in accordance with these Rules during the Purchase Period and your participation must be in accordance with these Rules. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by it) that any person has attempted to disrupt or participate in the CHEO 50/50 in any fraudulent or misleading way, then they may be disqualified from the CHEO 50/50 in the sole and absolute discretion of the Sponsor. The Sponsor, CHEO, their affiliates, and the organizations, prize suppliers (including, without limitation, Glenview Travel Inc., doing business as “Marlin Travel”), advertising/promotion agencies and any other individual(s) or entity(ies) involved in the development, production, implementation, administration or fulfilment of the CHEO 50/50, and each of their respective agents, employees, directors, officers, successors, members, assigns and other representatives (collectively, “Released Parties”) are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed, incomplete or incompatible Tickets, Ticket purchase attempts, and/or any other CHEO 50/50-related information (collectively, “CHEO 50/50-Related Information”), all of which are void.

All CHEO 50/50-Related Information and participants are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor, including, without limitation, government issued photo identification): (a) for the purposes of verifying a participant’s eligibility to participate in the CHEO 50/50; (b) for the purposes of verifying the eligibility and/or legitimacy of any CHEO 50/50-Related Information and/or any other information provided (or purportedly provided) for the purposes of the CHEO 50/50; and/or (c) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering the CHEO 50/50 in accordance with the letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by it, may result in disqualification in the sole and absolute discretion of the Sponsor.

Draws and Prizes:

The First Early Bird Draw will be held on Thursday, March 7, 2024. During the First Early Bird Draw, the Sponsor will select one (1) Ticket number by a random number generation system, from among all eligible Tickets purchased on or before the First Early Bird Draw purchase deadline set out above, to be the First Early Bird Prize winner. The “First Early Bird Prize” consists of a trip for two (2) to Margaritaville Island Reserve, Riviera Maya, Mexico, including: (a) round-trip economy airfare for two (2) people to Riviera Maya, Mexico from Ottawa, Ontario or Toronto, Ontario (as determined by the Sponsor in its sole and absolute discretion); (b) six (6) nights hotel accommodation at Margaritaville Island Reserve resort (one (1) room, double occupancy).  The total approximate retail value of the First Early Bird Prize is $10,000 CAD (based on an Ottawa, Ontario hypothetical departure point example). IMPORTANT NOTE: For certainty, the confirmed winner and their guest are solely responsible for any required travel (and associated costs) to travel to/from the applicable departure city. The odds of winning depend on the number of Tickets purchased on or before the First Early Bird Draw purchase deadline. The selected First Early Bird Draw Ticket will be included in all subsequent draws.

The Second Early Bird Draw will be held on Thursday, March 21, 2024. During the Second Early Bird Draw, the Sponsor will select one (1) Ticket number by a random number generation system, from among all eligible Tickets purchased on or before the Second Early Bird Draw purchase deadline set out above, to be the Second Early Bird Prize winner. The “Second Early Bird Prize” consists of a 2023 Jeep Compass North, with a total approximate retail value of $49,952 or $45,000 in cash. The odds of winning depend on the number of Tickets purchased on or before the Second Early Bird Draw purchase deadline. The selected Second Early Bird Draw Ticket will be included in the Final Draw.

The Final Draw will be held on Wednesday, April 17, 2024. During the Final Draw, the Sponsor will select one (1) Ticket number by a random number generation system, from among all eligible Tickets purchased on or before the Final Draw purchase deadline set out above, to be the 50/50 Prize winner. The “50/50 Prize” consists of a cash prize, in an amount that is equal to fifty percent (50%) of the total Ticket sales for the CHEO 50/50 collected by the Sponsor during the Purchase Period (the value of the 50/50 Prize shall be determined by the Sponsor, in its sole discretion, on the basis of its official Ticket sales records).  The odds of winning depend on the number of Tickets purchased on or before the Final Draw purchase deadline. The confirmed 50/50 Prize winner will be given a cheque or electronic funds transfer in the amount of the declared 50/50 Prize value.

The winning Ticket numbers will be posted at cheo5050.ca the day after each Draw. Each winner will be contacted by a staff member of the Sponsor.

The First Early Bird Prize, Second Early Bird Prize and the 50/50 Prize (each, a “Prize”) are subject to the applicable Prize terms and conditions set out below. Winners may contact Sarah Larstone, Events Specialist, CHEO Foundation at 613-295-7776 to claim their Prize. Winners must have the original winning Ticket number and photo identification in order to claim their Prize.

The winning Ticket holders have six (6) months (from the applicable Draw date) to claim their Prize. Any Prizes not claimed will be secured or placed in safekeeping for a period of up to six (6) months from the date of the Draw. If, at the end of such six (6) month period, the Prize has still not been claimed, the Prize or monies equivalent to the fair market value of the Prize will be donated to a beneficiary approved by the applicable licensing authority.

If a potential winner does not accept (or cannot accept or is unwilling to accept) a Prize, as awarded, for any reason, and/or is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion), then they will be disqualified and forfeit all rights to the applicable Prize.

The following terms and conditions apply to each Prize: (a) the Prize must be accepted as awarded and is not convertible to cash (except as may be specifically permitted by the Sponsor in its sole and absolute discretion); (b) winners may transfer their Prize; (c) no substitutions are permitted, except at the Sponsor’s option (the Sponsor reserves the right to substitute a Prize, in whole or in part, in the event that all or any component of such Prize is unavailable with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award); (d) all characteristics and features of the Prize, except as otherwise explicitly stated above, are at the Sponsor’s sole and absolute discretion; (e) the Prize winner is solely responsible for all costs not expressly described herein; and (f) the Sponsor will require, in its sole and absolute discretion, that an eligible winner sign and return its form of declaration and release prior to being confirmed as a winner.

Without limiting any of the foregoing, the following additional terms and conditions apply to the First Early Bird Prize: (a) this trip must be booked through the Sponsor’s First Early Bird Prize provider, Marlin Travel, by December 15, 2024 at 5:00 p.m. ET. and is not valid for travel from December 21, 2024 to January 4, 2025 (b) the confirmed winner and their guest must: (i) travel on same itinerary; (ii) have all necessary documentation to permit travel and participate in the First Early Bird Prize; and (iii) must not have any legal barrier to travel to, and return from, the same destination point; (c) the costs of everything not specifically and expressly stated above as included in the First Early Bird Prize are the sole and absolute responsibility of the confirmed winner and their guest, including, without limitation, travel or medial insurance costs, food expenses, incidental travel expenses, items of a personal nature and other fees (NOTE: the confirmed winner and guest may be required to present a valid major credit card in their name at the time of hotel check-in to cover any incidental hotel expenses or damages); (d) if the confirmed winner and their guest do not utilize any part(s) of the First Early Bird Prize for any reason, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (e) the Sponsor reserves the right at any time to place reasonable restrictions on the availability or use of the First Early Bird Prize or any component thereof; (f) all travel arrangements relating to the First Early Bird Prize must be made through Marlin Travel or its designated agents; (g) by accepting the First Early Bird Prize, the confirmed winner and their guest agree to waive all recourse against the Released Parties if the First Early Bird Prize or a component thereof does not prove satisfactory, either in whole or in part; (h) neither the Sponsor nor any of its Prize suppliers will replace any lost or stolen Tickets; (i) the confirmed winner’s guest must be the legal age of majority in their province/territory of residence, or if a minor, the confirmed winner must be such minor’s parent or legal guardian or such minor guest must travel with the written permission of their parent or legal guardian in form and substance that complies with all applicable laws, regulations and travel requirements, and in a form and substance acceptable to Sponsor in its sole discretion; and (B) will be required  to sign and return its release (by the date indicated on the release form) indicating that they waive all recourse against the Released Parties relating to their participation in the First Early Bird Prize (including, without limitation, any travel related thereto); (j) any difference between the actual value of the First Early Bird Prize and its stated approximate retail value will not be awarded; (k) all characteristics and features of the First Early Bird Prize (and of each element thereof), except as otherwise explicitly stated above, are at the Sponsor’s sole and absolute discretion; (l) precise travel arrangements are subject to space and flight availability and shall be made at the Sponsor’s sole and absolute discretion; (m) once booked, travel arrangements may not be changed by the First Early Bird Prize winner and/or guest; (n) certain blackout dates and further restrictions may apply; (o) the Released Parties will not, in any way, be responsible (and for greater certainty, are not obligated to offer any substitute prizing) in the event that any part of the First Early Bird Prize is delayed, postponed, re-scheduled or cancelled for any reason whatsoever; (p) the Sponsor reserves the right to change any of the First Early Bird Prize dates and/or the First Early Bird Prize description at its sole and absolute discretion; (q) by participating in the First Early Bird Prize, the winner and their guest each: (i) signify that they understand, acknowledge and accept that participation in the First Early Bird Prize may involve danger and/or exposure to risks and hazards (including, without limitation, as may be due to the inherent risks of travel and as may be due to possible COVID-19 exposure or infection), whether arising from foreseeable or unforeseeable human error and negligence, and that, as a result, they may suffer damage to personal property, serious personal injury, illness or even death; (ii) signify that they acknowledge and agree that the Released Parties have not made any warranties, guarantees or representations about their safety while participating in the First Early Bird Prize; and (iii) represent and warrant that they have evaluated the nature, scope, and extent of the risks involved, and freely and voluntarily agree and assume any and all such risks arising out of or connected with their participation in the First Early Bird Prize.

Without limiting any of the foregoing, the following additional terms and conditions apply to the Second Early Bird Prize: (a) the Second Early Bird Prize vehicle (“Vehicle”) trim, colour and other specifics will be selected at the Sponsor’s sole discretion (and is subject to available inventory); (b) all costs associated with the Second Early Bird Prize (including, but not limited to, license, insurance and registration fees), except as expressly set out above, shall be the sole responsibility of the confirmed winner; (c) IMPORTANT NOTE: the approximate retail value of the Second Early Bird Prize noted above is current as of the date of preparing these Rules, under no circumstances whatsoever will any difference between the actual retail value of the Second Early Bird Prize as at the time of fulfilment and the approximate retail value of the Second Early Bird Prize noted above be awarded; (d) if the confirmed winner does not utilize any part(s) of the Second Early Bird Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (e) the Sponsor reserves the right at any time to place reasonable restrictions on the availability or use of the Second Early Bird Prize or any component thereof; (f) by accepting the Second Early Bird Prize, the confirmed winner agrees to waive all recourse against the Sponsor and all of the other Released Parties if the Second Early Bird Prize or a component thereof does not prove satisfactory, either in whole or in part; (g) in the event that the eligible Second Early Bird Prize winner does not have a valid driver’s licence or is not legally eligible to operate the Vehicle, the eligible Second Early Bird Prize winner may be permitted to transfer the Second Early Bird Prize to an individual who meets the necessary requirements as specified in these Rules; and (h) the Second Early Bird Prize will be awarded at a dealership selected by the Sponsor in its sole discretion (it is the sole and absolute responsibility of the confirmed Second Early Bird Prize winner to arrange for their own transportation and/or accommodations, as applicable, to and from the applicable dealership).

General Conditions:

The decisions of the Sponsor with respect to all aspects of this CHEO 50/50, including, without limitation, the eligibility of participants or any CHEO 50/50-Related Information, are final and binding on all participants without right of appeal. The sole determinant of the time for the purposes of the CHEO 50/50 will be the official time-keeping device(s) used by the Sponsor. Anyone deemed by the Sponsor to be in violation of the Sponsor’s interpretation of the letter and/or spirit of these Rules for any reason is subject to disqualification in the sole and absolute discretion of the Sponsor at any time. 

All CHEO 50/50-Related Information becomes the property of the Sponsor. The Released Parties will not be liable for: (a) any failure of any website or platform during the CHEO 50/50; (b) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (c) the failure of any CHEO 50/50-Related Information, winner notification message and/or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the Internet or at any website; (d) any injury or damage to a participant’s or any other person’s computer or other device related to or resulting from participating in the CHEO 50/50; (e) anyone being incorrectly and/or mistakenly identified as a winner or eligible winner; (f) any liability caused, in whole or in part, by any act of God, fortuitous event or force majeure; and/or (g) any combination of the above.

The Sponsor reserves the right, in its sole and absolute discretion, to cancel, withdraw, amend or suspend the CHEO 50/50 (or to amend these Rules) in any way, without prior notice or obligation, in the event of any cause beyond its reasonable control that interferes with the proper conduct of the CHEO 50/50 as contemplated by these Rules, including, without limitation, any error, problem, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind whatsoever, in the event of any accident, printing, administrative or other error of any kind, or for any other reason whatsoever. Any attempt to undermine the legitimate operation of the CHEO 50/50 in any way (as determined by the Sponsor in its sole and absolute discretion) may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, in its sole and absolute discretion, to adjust any of the dates, timeframes and/or other CHEO 50/50 mechanics stipulated in these Rules, to the extent deemed necessary by the Sponsor, for the purposes of verifying compliance of any participants, CHEO 50/50-Related Information and/or other information with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the CHEO 50/50 as contemplated in these Rules, or for any other reason.

By participating in the CHEO 50/50, each participant expressly consents to the Sponsor, CHEO and their respective agents and/or representatives, storing, sharing and using the personal information submitted them, only for the purpose of administering the CHEO 50/50 and in accordance with the Sponsor’s privacy policy (available at: https://cheofoundation.donordrive.com/index.cfm?fuseaction=donorDrive.privacy). Without limiting the generality of the foregoing, all winners hereby agree and consent to the use of their name and photo for publicity purposes by the Sponsor. This section does not limit any other consent(s) that an individual may provide the Sponsor, CHEO or others in relation to the collection, use and/or disclosure of their personal information.

In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any CHEO 50/50-related materials, including, but not limited to, point of sale, television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law. For clarity, the English language version of these Rules shall be the original, governing instrument. Although these rules are also available in French, the English language version shall govern and control in the event of any discrepancy or inconsistency.

The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein. To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of participants, the Sponsor or any of the other the Released Parties in connection with the CHEO 50/50 will be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. The parties consent to the exclusive jurisdiction and venue of the courts located in Ontario in any action to enforce (or otherwise relating to) these Rules or relating to the CHEO 50/50.
